Well, he did violate the law by creating that device, and the device itself was meant to do one thing, which we all know. Kind of like serial/key generators for pirated programs, they "could" be used for piracy but overall they are illegal because the DMCA prohibits it.
The way I understand it, Sony had the right to do what they did. Somone violated the law by hacking their hardware, they had the right to sue him and defend their business. They profit from the fact that PS3 hasn't been "pirated" yet (to a large extent anyways) I also read more about the IP collecting and it appears they did that to prove that he distributed the hack and to resolve the issue of where to sue him and they had no intention of suing people who visited his website or downloaded jailbreak, only the ones who will redistribute it.
