Jail time for streaming?!??

That still means that many of the great online content that we (or at least I) have enjoyed (like these streams, I'm watching the Break at 8 replay right now actually) from the recent resurgence of FGs will be pretty much done for.
 
Well it's criminal law, they always have to prove intent(not to break the law but to take the action which breaks the law). All the same I don't want to be having to defend on Mens Rea grounds against a federal prosecutor, they could convict a ham sandwich if they tried hard enough.
 
honestly i don't see this effecting us. this is meant to prevent people from streaming broadway shows, posting streaming movies and such. unless namco decides to suddenly crack down on fans for hyping their games, it seems to be a non-issue.
 
I also don't agree with the fact that they are making this act a felony! If you're so intent on making streaming a criminal act, why would you put streamers in the same league as murderers and rapists? Misdemeanor doesn't cut it?

lobo: i think the government can bust 'offenders', even if the copywrite holder chooses not to act, since its criminal law.
 
That's the concern that they are raising in that article lobo, because the remedy is criminal and not civil, it's the government that gets to decide who gets prosecuted. Obviously streamers are going to fly low on the radar and without any mandate to prosecute they may very well get away unscathed. All the same, you don't want congress outlawing anything you do habitually, even if you don't expect anyone to enforce it.
